PERAN POS BANTUAN HUKUM (POSBAKUM) DALAM MEMBERIKAN LAYANAN BANTUAN HUKUM DI PENGADILAN AGAMA KUALA TUNGKAL DI TINJAU PERMA NOMOR 1 TAHUN 2014 BAB V PASAL 25
Abstract
People who can't afford it will have difficulties when they are entangled in legal problems, this is because one of the factors is legal illiteracy. They don't know what to do, especially when it becomes a court case. They do not have the money to pay for everything related to the cases they face. In accordance with PERMA No. 1 of 2014 concerning Guidelines for Provision of Legal Services for the underprivileged in Court, that legal aid services that can be provided by the Legal Aid Post are in the form of providing information, consultation, and advice as well as the provision of a companion Advocate free of charge to defend the interests of the Suspect/Defendant in matters The defendant did not pay for his own legal counsel.
The main problem of this research is how to carry out the role, constraints and efforts of the Legal Aid Post (Posbakum) in providing legal aid services at the Kuala Tungkal Religious Court in Review PERMA No. 1 of 2014. The purpose of this study was to find out the role, constraints and efforts of the Legal Aid Post (Posbakum) in providing legal aid services at the Kuala Tungkal Religious Court.
The approach used in this research is a statute approach which is carried out by examining regulations related to legal aid. This type of research is Empirical Juridical Legal Research with data collection techniques through observation, interviews and documentation with previously determined informants. The data obtained from the research were analyzed in a descriptive way, namely research that seeks to describe the current problem solving based on the data.
The results of this study indicate that: (1) The Kuala Tungkal Religious Court's legal aid post (Posbakum) performs the role of providing legal aid services in the form of providing information, consultation, legal advice, and preparing documents needed in a case.
(2) In providing services, the obstacles faced were the existence of the Posbakum at the Kuala Tungkal Religious Court, restrictions on the provision of legal services, lack of information regarding the existence and role of the Posbakum itself and the location of the Posbakum. (3) For this reason, the efforts made to deal with the obstacles that occur are disseminating information about the existence of the Posbakum, increasing the budget and the role of the Posbakum and providing legal knowledge to the public who are not familiar with the law related to Posbakum & Procurement of Question and Answer Websites.
