Abstract

The essence of the constitutonal is very imprtanta because it is official document. Even though there are no verses in the koran that explicitly ordered or obligated muslims to establish a state, not even the term daulah (state). Ever mentioned in the koran, but the elements foundation in society, nation and state found therein. Fiqih siyasah as one aspect islamic law which deals with requlation and administration human life in the human relationship with Allah swt as ultimate and absolute ruler over the word, governs relations between humans and the relationship between humans and naturel. In this case, Islam views the state as not only related with the world alone, the purpose of forming a country within forming laws aiming to preserve religion, soul, reason, lineage and preserving wealth.
